Terms and Conditions

1. Eligibility

You must be at least 13 years old to create an account and use the Services. By using the Services, you represent that you meet this requirement. Parents or guardians are responsible for monitoring use by minors aged 13 to 18.

2. Account Registration and Security

You agree to provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Notify us immediately at support@kootenayconnection.app if you suspect unauthorized access or compromise.

3. Subscription Passes and Billing

Kootenay Connection offers seasonal digital passes, including Regular and VIP tiers. Pricing, benefits, and redemption limits are described within the Services and may change with notice. Purchases made through the Apple App Store or Google Play Store are subject to their respective terms and billing practices.

• Renewals: Passes may auto-renew depending on platform configuration. Manage or cancel renewals via your Apple or Google account settings before the renewal date to avoid charges.
• Refunds: All transactions are final except where required by law or platform policy. Submit refund requests through the platform provider.
• Upgrades: Upgrading from Regular to VIP within a season applies a credit for unused Regular value, as indicated in the app.

4. Offer Redemption Rules

Offer availability, redemption limits, and participation of merchants may change without notice. You must present your active pass in the app at the time of redemption and comply with merchant-specific terms (such as minimum purchase requirements or blackout dates). Misuse, fraud, or sharing of passes may result in suspension or termination.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or otherwise attempt to extract source code from the Services.
• Interfere with or disrupt the integrity or security of the Services or supporting infrastructure.
• Use automated scripts or bots to access the Services or scrape content.
• Upload viruses, malware, or harmful code.
• Harass, abuse, or harm other users, merchants, or our staff.
• Use the Services for any illegal purpose or in violation of applicable laws or regulations.

6. Intellectual Property

The Services, including all software, content, designs, graphics, and trademarks, are owned or licensed by Kootenay Connection Marketing and protected by intellectual property laws. You may access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. User Content

If you submit feedback, reviews, or other content, you grant Kootenay Connection Marketing a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the Services. You represent that you have the rights to share such content and that it does not infringe any third-party rights.

8. Third-Party Services

Our Services integrate third-party offerings, including Google Maps, Firebase, and RevenueCat. Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party content, services, or availability.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, nor do we guarantee that offers will remain available, accurate, or redeemable.

10. Limitation of Liability

To the maximum extent permitted by law, Kootenay Connection Marketing, its affiliates, directors, employees, and partners will not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, data loss, or business interruption, arising from or related to the Services or these Terms. Our total liability for direct damages will not exceed the greater of (a) CAD $100 or (b) the amounts you paid to us in the twelve-month period preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold Kootenay Connection Marketing and its affiliates harmless from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms, engaged in fraudulent activity, or created risk or liability for other users or merchants. You may discontinue use at any time by deleting your account and uninstalling the app. Sections intended to survive termination, including intellectual property, disclaimers, limitations of liability, and indemnification, remain in effect.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and federal laws of Canada, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.

14. Changes to These Terms

We may update these Terms to reflect changes in our Services, legal obligations, or business practices. Material updates will be communicated through the app, email, or by updating the effective date on this page. Continued use following updates constitutes acceptance of the revised Terms.
